Definitions

'Non-personal data' (NPD) is information that is in no way personally identifiable. 'Personal data' (PD) means any information relating to an identified or identifiable natural person ('data subject'); an identifiable natural person is one who can be identified, directly or indirectly, by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person. PD is in many ways the same as Personally Identifiable Information (PII). However, PD is broader in scope and covers more data.

A "Visitor" is someone who merely browses our website. A "Member" is someone who has registered with us to use our services or buy our products. The term "User" is a collective identifier that refers to either a Visitor or a Member.

In addition, WhatConverts honors the Global Privacy Control (GPC) opt-out preference signal. We will need to verify your identity before fulfilling certain requests and may ask you to provide information sufficient to confirm that you are the person about whom we collected personal information. California Civil Code Section 1798.83 permits California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Our Legal Basis for Collecting and Processing Your Personal Data (PD)

Where required by applicable law (including the GDPR and similar international privacy frameworks), we process personal data only when we have a valid legal basis. Depending on the context and the nature of the interaction, our legal bases may include:

• Performance of a contract or steps to enter into a contract. For example, to create and administer an account, provide the services you request, process transactions, deliver service communications, and provide customer support.

When Buying Products or Services

Phone Calls

When you use call-related features (including call tracking or support calls), we may collect and store call metadata (for example, caller/callee numbers, call time, duration, routing information, call outcomes, and other identifiers), as well as any additional information provided during the call (for example, information you say, keypad/DTMF inputs, voicemail content, and any information shared to identify you or resolve your request). If you or your end users upload, attach, or otherwise provide related materials during a call-related workflow (for example, notes, files, or follow-up details), we may collect and store those materials as part of the call record.

If call recording, transcription, or monitoring is enabled for a particular feature or support workflow, we will provide notice and obtain consent where required by applicable law. Recordings, transcripts, and related call logs, if collected, may be retained as part of our business records for customer support, troubleshooting, quality assurance, training, dispute resolution, fraud prevention, security, and compliance purposes.

Text Messages

When you send or receive text messages through our services or communicate with us by text, we may collect and store message content, sender/recipient numbers, timestamps, routing information, delivery status, and related identifiers, as well as any additional information provided within the message thread or associated with that interaction (for example, attachments, images, links, opt-in/opt-out keywords, and other content you choose to send). We use and store this information to provide messaging functionality, support troubleshooting, maintain records, prevent abuse, comply with legal obligations, and provide customer support.

Chat Sessions and Website Chat Software

We may offer chat functionality through our website and/or within our services that allows visitors, customers, and end users to communicate with us (for example, live support chat, offline chat by leaving a message, or chat-enabled workflows within the platform). In some cases, a visitor may be able to use website chat without becoming a member or buying products or services. When chat is available, we may collect and store information related to the chat interaction and the context in which the chat occurs.

• Affirmative Consent Required to Start a Website Chat Session (Where Presented): Where the website chat experience presents an "Accept" / "Decline" option, the chat session will not begin unless the user clicks "Accept." By clicking "Accept," the user confirms that they have read and agreed to our Terms of Use and Privacy Policy as it relates to chat communications, and consents to our collection, use, and storage of chat data as described here. If the user clicks "Decline," the chat session will not initiate, and the user may contact us using other methods listed in the "Data Controller Contact Information" section. Where required by law (including certain jurisdictions that regulate the interception, recording, or monitoring of communications), we use this affirmative consent mechanism to help ensure the user is informed and to obtain consent before the chat session begins.
• What We Collect Through Chat: When a visitor, customer, or end user uses chat, we may collect identifiers and contact information the user provides (such as first name, last name, email address, phone number, and company information where provided), technical data (such as IP address, device/browser information, timestamps, session identifiers, and approximate location derived from IP), and any additional information provided during the chat, including the content of messages, the full chat transcript, and any files, screenshots, or attachments the user chooses to provide. We may also collect information about how the chat was initiated (for example, which page or feature the user was viewing), the time and duration of the chat, and internal notes, tags, or routing fields associated with the chat for support and operational purposes.
• How We Use Chat Data: We may use and store chat data to provide customer support and respond to requests; operate, secure, and maintain the chat feature and our services; route inquiries; verify identity where appropriate; prevent fraud and abuse; troubleshoot technical issues; improve support quality and train staff; maintain business records for troubleshooting and dispute resolution; comply with legal obligations; and enforce our Legal Terms.
• Storage, Retention, and Access Controls: Chat messages and transcripts may be stored in our systems and/or in the systems of third-party providers that help us deliver the chat feature. Chat transcripts may be retained in accordance with the "Retaining and Destroying Your PD" section of this Privacy Policy. Access to chat transcripts may be limited to personnel and service providers who need access for support, quality assurance, security, compliance, and operational purposes. We may also retain chat-related logs and metadata to maintain security, prevent abuse, and demonstrate compliance with legal obligations.
• Do Not Send Sensitive Information: Users should limit the information provided through chat to what is necessary to answer questions or provide support and should not provide sensitive information via chat (for example, passwords, full payment card details, government-issued identification numbers, or health information) unless specifically requested for a lawful, necessary purpose.

E-Commerce Transactions

When transactions are conducted through our services, we may collect and store transaction records (for example, purchase details, billing plan information, amounts, timestamps, and identifiers), along with associated account information and any additional information provided during the purchase or checkout process (for example, billing contact details, invoice fields, tax information where applicable, purchase notes, or communications related to the transaction). We may also store transaction-related communications (for example, receipts, invoices, confirmations, payment status messages, and customer support communications) and related metadata. We retain these records for accounting, tax, fraud prevention, chargeback handling, customer support, and compliance purposes, consistent with our retention practices.

Form Submissions

When forms are submitted through our website or services, we may collect and store the information included in the submission and any additional information provided through the form or associated workflow, such as identifiers, contact details, message content, custom fields, and attachments. We may also collect technical details associated with the submission (for example, timestamps, source page, and IP address). Emails

When you email us, when we email you, or when email features are used within the service, we may collect and store email content and any additional information provided within the email thread, such as subject lines, sender/recipient information, message bodies, attachments, and any information you include in signatures or replies. We may also collect and store related metadata and technical information (for example, timestamps, message headers, routing information, bounce/delivery status, and communication history). We use and store email communications to provide customer support, respond to requests, manage customer relationships, deliver service-related notices, maintain records for troubleshooting and dispute resolution, improve support quality and training, and comply with legal obligations. Where applicable, we may store internal notes or ticketing records that reference or summarize email communications as part of our support workflows.

Customer Defined Events

Our services may allow customers to define, configure, or transmit events and event attributes (for example, conversion events, tags, custom fields, and related identifiers). We may collect and store the events, attributes, and any additional information provided as part of those events (for example, event payload fields, timestamps, source identifiers, and user-defined metadata) to provide reporting and analytics, power service functionality, troubleshoot issues, prevent abuse, and improve the service. Depending on your configuration and what you send to us, customer-defined events may include PD.

User Behavior

We may collect and store usage data and activity generated through the platform, including actions taken within the app, feature usage, navigation patterns, click paths, session duration, and performance telemetry (for example, error logs, latency, and crash reports). This may also include any additional information generated as part of your use of the service, such as configuration changes, account-level settings, and other activity logs. We use this information to provide and maintain the service, detect and prevent abuse, monitor reliability, debug issues, understand feature adoption, improve product design, and develop new features.

Additional note on service providers and storage For the categories above, we may use third-party service providers to help deliver features (for example, hosting, analytics, communications infrastructure, customer support systems, and payment processing). Google Analytics 4 Privacy Policy

Our website uses Google Analytics 4 (GA4), the event-based analytics service provided by Google, to collect information about the use of our website. GA4 collects information such as IP address (which is collected and processed in a truncated/anonymized form by default), device and browser information, approximate geographic location, pages viewed, events triggered, referral source, time spent on pages, and other interaction data. Facebook Pixel:

We use the Facebook Pixel, along with related cookies, web beacons, and similar technologies, to collect and receive information about your interactions with our website. This information is used by Facebook and us to measure and optimize advertising, build custom audiences, deliver remarketing ads to people who have visited our site, and create lookalike audiences of users similar to our existing visitors and customers. Zoho SalesIQ:

We use Zoho SalesIQ to provide live chat, visitor tracking, and engagement features on our website. Zoho SalesIQ may collect information such as your IP address, approximate location, browser and device information, pages viewed, time spent on pages, referral source, chat transcripts, and any information you provide during a chat session (such as your name, email address, phone number, and message content). ClickCease:

We use ClickCease, a click fraud detection and prevention service, to protect our paid advertising campaigns. Datadog:

We use Datadog as part of our monitoring, observability, and security infrastructure. Datadog may collect technical and operational information related to your use of our website and services, including IP address, device and browser information, session identifiers, performance metrics, error logs, and other telemetry data. We use this information to monitor performance and availability, detect and troubleshoot errors, investigate security incidents, prevent abuse, and improve the reliability of our services.

Google Remarketing:

Why am I seeing ads by Google for products I've viewed?

Our website uses a remarketing advertising service. Our remarketing service is provided by Google and other companies that show our ads on websites across the Internet. With remarketing you may see ads for our products you have previously looked at. As an example, suppose you visit a website that sells computers, but you do not buy a computer on your first visit to that website. The website's owner might like to encourage you to revisit his/her site and buy a computer by showing you his/her ads again on other websites that you visit. We use remarketing for similar purposes.
